A recent article suggests that there is growing public concern over brain injuries caused by concussions. That attitude is perhaps a reflection of the media attention over the class action lawsuit brought by retired NFL players. The class action complaint alleged improper diagnosis and care of brain injuries, as well as inadequate warnings. A $1 billion settlement resolved that litigation, but many questions remain about the diagnosis and treatment of brain injury resulting from head trauma.
Unfortunately, the standard of care provided to concussive victims may be uneven. One professional, for example, keeps a notebook filled with examples of bad medical advice that his high school athletes have received from their doctors, noting incorrect diagnostic advice.
How exactly is a concussive injury diagnosed? Not with blood tests or brain scans. For example, an MRI cannot definitively diagnose a concussion. Rather, neurologists say that a number of tools must be used, including tests of balance, movement and vision, cognitive abilities, and an analysis of all medical symptoms that are occurring.
If you have been injured in an accident and suffered head trauma as a result of another individual’s negligence, it is important to consult with an attorney to protect your rights. Although an insurance company may attempt to settle the claim, the full impact of your injuries may take time to correctly gauge. As a law firm that focuses on personal injury law, we understand the process for estimating damages. Although it may be tempting to accept a quick resolution, our advocacy will help you pursue the compensation you truly deserve.
